By registering for any of Soccer Club Dava’s soccer training programs on this website, you agree to the following terms and conditions:
Soccer Club Dava, a Texas-based organization (“we” or “us”), provides the Soccer Club Dava Soccer Training Programs (the “Soccer Training Program”) described in the accompanying brochure. These terms and conditions apply to the Soccer Training Program named on the Guest Reservation and Payment Form (the “Soccer Training Program”) and the program for this Soccer Training Program.
Reservations:
A completed payment fee per participant, depending on the program chosen (except when otherwise noted in writing by us), and a completed Registration Form (“Registration Form”) are required with this Participant Agreement to reserve space for the Soccer Training Program. All prices are in U.S. Dollars. Except as expressly stated in the brochure, you are solely responsible for any Soccer Training Program-related costs that you incur.
Client Cancellation & Refund Policy:
If you choose to cancel your registration, we must receive written notice of said cancellation either via certified mail, overnight courier, or e-mail sent to info@scdava.com (with confirmation of receipt from us), and you shall be subject to the following cancellation fee:
- If we receive a written notice 60 days prior to the training date, the organization will retain $95.00 as compensation for the registration expenses.
- If we receive a written notice between 60-30 days of the training date, the organization will retain 50% of the payment fee paid.
- If we receive a written notice of cancellation within 30 days of the training date, there will be no refunds of the amount paid for the Soccer Training Programs.
- If the participant simply does not show up for the training, there will be no refunds for the amount paid.
Cancellation or Substitution:
We may cancel any Soccer Training Program at any time for any reason, including, without limitation, if the number of participants signed up for a given program falls below the minimum threshold necessary for operational purposes. We may also change the current location to one within a 25-mile radius due to factors beyond our control. We will make commercially reasonable efforts to maintain the published schedule and location; however, the final schedule may vary due to unforeseen circumstances. We may, at our sole discretion, substitute services or goods of similar quality for any service or good listed in the schedule. If the Soccer Training Program is cancelled, our liability is limited to a full refund of your deposits and Soccer Training Program price. While we will make every effort to minimize inconvenience, we will not be liable for any other costs, damages, or refunds for any loss, delay, inconvenience, disappointment, or expense whatsoever under such circumstances. If, for reasons beyond Soccer Club Dava’s control, a Soccer Training Program in progress must be interrupted or cancelled, we will, in good faith, consider refunding a portion of the Soccer Training Program price based on the remaining days of the program and our actual costs incurred compared to the Soccer Training Program as originally planned.
Certification of Participant’s Health; Responsibility to Inform Operator of Disabilities or Pregnancy:
By signing below and/or tendering any portion of the Soccer Training Program fee to us, you certify that you do not have any condition or disability that would create a hazard for you or others participating in the Soccer Training Program. You agree to inform us via certified mail or e-mail sent to info@soccerclubdava.com (with confirmation of receipt thereof from us) at the time you tender your first payment of the Soccer Training Program Fee (or at such later time when you become aware of such a condition) of any existing physical or mental illness, disability, pregnancy, or any other condition for which you may require medical attention or special accommodation during the Soccer Training Program. We make no guarantee to be able to accommodate you for such a condition during the Soccer Training Program, and we make no representations or warranties regarding special accommodations or handicap accessibility on the Soccer Training Program.
Athletics Release:
You hereby acknowledge that playing or practicing soccer is a potentially hazardous activity. You agree that you are voluntarily entering and assuming all risks associated with participating in those activities, including but not limited to falls, contacts with other participants, the effects of weather including heat and/or humidity, and the conditions of the training grounds and facilities, all risks being understood and appreciated by you. Having read this waiver, and knowing these facts, and in consideration of Soccer Club Dava’s acceptance of this application, you hereby waive and release Soccer Club Dava and its representatives from all claims and liabilities of any kind arising out of your participation in soccer playing, practicing, or training.
Responsibility/Liabilities:
We act only in the capacity of agent for providing services or goods in connection with the Soccer Training Program (the Suppliers), camp operators, and providers of entertainment. We assume no responsibility for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned either by reason (1) any act or omission of any of the Suppliers (2) any matter beyond our exclusive control including but not limited to a delay or cancellation of a flight that causes you to miss any portion of the Soccer Training Program. We have no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at the training locations. You are also responsible for respecting the authority and following the directions of the Soccer Training Program guide during the training. We may exclude you from participating in all or any part of the Soccer Training Program if, in our sole discretion, your condition or behavior renders you unfit for the Soccer Training Program or unfit for continuation once the program has begun.
Unfitness:
Unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of Soccer Training Program services, or may constitute a hazard or embarrassment. In such case, our liability shall be strictly limited to a refund of the recoverable cost of any unused portion of the program.
Image Rights:
Since the right to images is regulated by article 18.1 of the Constitution, by Organic Law 1/1982 on the right to honor, personal and family privacy, and by the Organic Law 15/1999 of Protection of Personal Data, Soccer Club Dava and related entities ask for their consent to record the image of the child registered and publish it clearly identifiable, in photographs and recordings corresponding to the activity of the Soccer Training Program, which may be exposed publicly in different media used by Soccer Club Dava and its partners for promotional and/or commercial purposes. This consent and authorization are granted free of charge and with formal renunciation of any economic consideration.
Special Provisions for Parent(s) or Guardian(s) of Participants:
I, the undersigned, as parent or guardian, give my consent for our child to participate in soccer activities during the training program. I understand that participation in any soccer event is done at our own risk. I will not hold Soccer Club Dava or its representatives responsible for injury occurring to the named participant during such activities or travel. I understand that Soccer Club Dava will complete required accident insurance forms, after which all claims under the insurance policy, for injuries received during the program, shall be processed by the participant’s parent(s) or guardian(s) through the appropriate insurance company and not through Soccer Club Dava.
Communicable Disease Release of Liability and Assumption of Risk Agreement:
I, the participant, parent, or legal guardian, acknowledge, appreciate, and agree that: By participating in Soccer Club Dava’s related events and activities, there are certain risks to me arising from or related to possible exposure to communicable diseases, including, but not limited to, the virus “severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2),” which is responsible for COVID-19, and/or any mutation or variation thereof (collectively referred to as “Communicable Diseases”). I am fully aware of the hazards associated with such Communicable Diseases and knowingly and voluntarily assume full responsibility for any and all risk of personal injury or other loss related to such Communicable Diseases.
